ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. A single operating schedule and set of house policies shall apply across the whole premises - the ground floor and the first floor alike, whichever is in use for a given event.
2. Event risk assessments, including whether external door staff are needed, shall be carried out or approved by the premises licence holder or the designated premises supervisor.
3. Any external door staff engaged shall be licensed by the Security Industry Authority.
4. A written record of each risk assessment shall be kept at the premises for six months and made available to the police or an authorised officer upon request.
5. Every sale of alcohol shall be made or authorised by a personal licence holder.
6. An incident and refusals book shall be kept at the premises, recording crime and disorder and any refused sales; entries shall be retained for at least twelve months and available for inspection.
7. Staff and volunteers who serve alcohol or work on the door shall receive training covering vulnerability awareness, crime scene preservation, drugs policy, underage and proxy sales, Challenge 25 and the recognition of fake identification, CCTV operation (authorised staff only) and dispersal, with refresher training at least annually from the first anniversary of employment. Written training records shall be retained for at least twelve months. Training needs shall be reviewed periodically.
8. A zero-tolerance policy shall apply to drugs on the premises and management shall carry out regular checks to deter use. Any drugs found shall be stored securely and handed to the police.
9. A CCTV system meeting the South Yorkshire Police specification (March 2025) shall be installed and operational within 30 days of the grant of the licence. From then, it shall be maintained and in use whenever licensable activities are taking place and for at least one hour before and after them, with images retained for 30 days and made available to the police and authorised council officers for the prevention and detection of crime, in line with GDPR guidance. The system will carry accurate time and date stamps, cameras installed from 2021 onward will be full digital wide dynamic range (WDR) IP cameras, and management will be trained in its use.
10. As a standard practice, glass-alternative drinking vessels shall be used in accordance with the premises' own risk assessment. Glass shall only be permitted for events where a specific risk assessment has been undertaken, such as for a seated wine tasting or similar event.
11. A Challenge 25 scheme shall operate for both on- and off-sales, with a refusals log, point-of-sale signage and staff training records maintained as above.
12. Staff shall be trained to recognise intoxication and refuse sales to anyone who appears drunk. Customers who are vulnerable or unwell shall be supported by trained staff, taken to a quiet area and, where needed, helped to get home safely. Drink spiking shall be taken seriously and staff shall be briefed on the signs. Customers shall be advised to report concerns, and any incident shall be recorded and reported to the police. Bags checks shall be undertaken at all gigs or other events where risk assessments say this is needed. SIA licensed door staff shall be engaged where security requirements are identified during event risk assessments.
13. A current fire risk assessment sets the capacity limits by reference to the width of the available emergency exits: 100 persons when the ground floor is in use (alone or with the first floor) and 60 persons when the first floor is used alone. The applicable capacity limit shall be monitored and enforced at the point of entry (for example by a clicker count or wristbands), so that admissions stop once the limit for that configuration of the premises is reached. Any temporary bar or other equipment shall be positioned so that it does not obstruct an exit or escape route, as recorded in the event risk assessment.
14. Alcohol service shall cease at least 30 minutes before customers are required to leave the premises.
15. Noise shall be controlled by the building and by management. All windows in the main venue and the small venue (the first floor practice room) shall remain closed during events. Outward facing windows have been acoustically treated with rock wool and are permanently closed, and the doors provide further acoustic insulation. There shall be no external speakers. Customers shall enter and leave through an entrance porch separated with further doors from the venue.
16. Neighbours shall be able to contact the venue by email at marystreetlive@gmail.com, which is shown on the community poster displayed next to the notice of application and is available at any time. Messages shall be answered promptly, and a record of any complaint and the action taken is kept.
17. A dispersal policy shall direct patrons away from residential frontages at closing, supported by signage and, where door staff are engaged, their presence at the point of exit.
18. Customers who smoke shall do so on the pavement outside the public entrance. Customers shall be asked not to take drinks outside, to keep noise low and to move away from neighbouring residential frontages; signage at the exit says so, and staff or volunteers shall monitor the pavement at busy events.
19. Off-sales shall be supplied in sealed or closed containers only, so that alcohol is not left open on departure, and they are subject to the same Challenge 25 checks as on-sales. Off-sales shall end at 23:00 every day.
20. Deliveries and waste collection shall be scheduled to avoid unsociable hours so far as reasonably practicable.
21. The Designated Premises Supervisor, Daniel Johnston, is also MSSL's Designated Safeguarding Lead and shall act as Safeguarding Coordinator, working in line with guidance and training provided by the Sheffield Children's Safeguarding Partnership.
22. A Challenge 25 scheme, refusals log and signage shall operate throughout the premises, with staff training records maintained as set out above.
23. Events and private functions involving children and young people shall be risk-assessed in advance by the Safeguarding Coordinator, with a written risk management plan produced and retained for inspection.
24. Events open to under-18s only shall be alcohol-free: no alcohol shall be sold or allowed to be consumed. Mixed-age events may sell alcohol from the bar where Challenge 25 applies, and no one under 18 shall be sold or allowed to consume alcohol. 25. Bags shall be checked at the door at all events open to under-18s, and entry to the venue or service at the bar shall refused to anyone who appears intoxicated. Staff and volunteers working at events involving children and young people shall hold DBS checks and safeguarding training in line with the safeguarding policy.
26. A booking form shall be used for all private hire events, recording the booking conditions, the name of the Mary Street Live manager authorising the booking, and the name and contact details of the hirer and records shall be retained for six months. Mary Street Studios Ltd shall retain responsibility for the premises, including for the rent, throughout any such hire.
