Additional Conditions
Any embedded permissions and restrictions attached to the justices on/off licence including those specified at Appendix 1. Specific conditions converted from the Justices Licence 1. The premises shall not be operated otherwise than as an Australasian themed sports bar without the consent of the Licensing Justices first having been obtained. 2. Substantial food will be available throughout the trading day until 30 minutes before closing time. 3. On no more than 25 occasions per calander year and on the dates listed at 3a below (in addition to applications for temporary events notices) and following 28 days notice to the police, the hours may be extended to a time agreed with the police. The police have the power to refuse any such application:- (a) Easter Sunday, the Sunday before May Bank Holiday, Sunday before Spring Bank Holiday, Friday, Saturday and Sunday of August Bank Holiday, Christmas Eve, Boxing Day, Australia Day (26th January), Waitangi Day (6th February), St Patricks Day (17th March), Anzac Day (25th April), Freedom Day (27th April) and the Queens Official Birthday (9th June). (b) In any event the licensee will not seek to agree opening hours with the police which would infringe the terms of their current planning permission. 4. The premises shall be permitted to open for licensable activities between the end of permitted hours on New Years Eve to the start of permitted hours the following day provided always that the premises shall not open for licensable activities during hours which would entail a breach of planning consent. 5. Suitable beverages other than intoxicating liquor (including drinking water) shall be available during the whole of the permitted hours. 6. At all times there will be a designated no smoking area. 7. A colour CCTV system to the specification of South Yorkshire Police will be installed both within and outside the premises in positions agreed with the Police and in use at all times the premises are open. Tapes will be retained for such period of time as it stipulated by the Police. 8. The maximum occupancy of the premises shall be such figure as is agreed from time to time with the Building Control Officer and/or the Fire Officer. 9. Save for games between Sheffield United v Sheffield Wednesday which will not be shown, a risk assessment will be conducted for any local derby soccer games that are shown at the premises. 10. No off sales save for consumption within the curtilage of the premises as identified on the deposited plan except in sealed vessels. 11. The Licensee shall prominently display large notices on all exits reminding the patrons to leave the premises in an orderly fashion. 12. All audio and amplified musical equipment on the premises shall be played through the approved sound limiting device and maintained at the approved level set with the Environmental Health Unit. 13. All windows and doors shall be kept shut save for access and egress whilst entertainment is being provided. 14. The Licensee shall, upon request, supply a landline telephone number for the premises to neighbours. 15. Any noise generated by plant or machinery internally or externally installed, music and human voices and other internal activities, should at the nearest façade of the nearest noise sensitive property from the premises (the LAeq5 min) not exceed 10dB below the minimum external background noise during the operating period. The background noise level should be expressed in terms of the lowest LA90, 15 min. 16. An acoustic lobby is installed at the premises as shown on drawing number 01.07/08 B. 17. Use of the external drinking area shall cease at 23:30 hours Monday to Saturdays and 22:30 hours on Sundays and Bank Holidays, save for patrons being allowed to use the area for smoking. 18. No speakers or other equipment for making or relaying music shall be installed outside the premises at any time. 19. The collection and disposal of bottles outside the premises shall not take place between the hours of 22:00 and 08:00 hours. 20. The use of explosives, pyrotechnics and fireworks of a similar nature which could cause disturbance shall be prohibited. 21. Door supervisors shall assist in the quiet and orderly dispersal of customers. 22. DJs to remind patrons to leave quietly. 23. To acquire a suitable number of radio set(s) for that premise and take the CCRAC Radio Scheme into use at all times when trading, and continue to be a user whilst. This system/facility is in use Sheffield. 24. The part of the premises subject to the alterations is not to be traded, until it has been inspected by all authorities, and is found to be satisfactory. 25. The Designated Premises Supervisor for these premises must be registered member of Sheffield Licence Watch. Annual membership and meeting attendance should be maintained. 26. There shall be no entry or re-entry to the premises after 02:00 hours. 27. A member of staff shall supervise the use of the outside area daily from 23:00 hours until the close. 28. A children and young people's risk assessment is to be undertaken in writing prior to the screening of any sporting events at which persons under the age of 18 are present. The risk assessment should inform the operating policy and staff briefings prior to sporting events and should be retained for 28 days subsequent to each event and made availableto the responsible authorities for inspection on request. 29. Persons under 18 must be accompanied by a responsible adult at all times. 30. No Persons under the age of 18 years to be on premises after 20:00 hours on Friday & Saturday and 21:00 hours Sunday to Thursday. Specific conditions converted from the Public Entertainment Licence 1. Capacity 1) The number of members of the public who may be present at any one time on the premises or in any part of such premises specified below shall not exceed: - Area Capacity Ground Floor 400 First Floor 330 Other Special Conditions 2. When the screen is in use and the first floor is open, access must be prohibited to the area where the screen is located and the area appropriately stewarded. 3. Dancing will be permitted on the premises subject to the satisfactory completion of the proposed dance floor as outlined on the plan 01.07/08 Rev A and all necessary requirements of Environment and Regulatory Services. 4. When the dance floor is in use for dancing, balustrading will be erected as shown on the enclosed plan of the premises (Drawing No. 01.07/08 Rev A) and the dance floor will be delineated by virtue of its floor covering as agreed with Sheffield City Council Environment and Regulatory Services.
