Additional Conditions
1 1. The electrical circuits serving the premises must be examined and tested by a competent person in accordance with the current edition of the Institute or Electrical Engineers regulations, to ensure a satisfactory certificate for the premises is available to be viewed by any responsible authority. 2. A colour CCTV system to the Recognition Quality specification of South Yorkshire Police will be fitted, maintained and in use at all times that the premises are open. CCTV images will be stored for 28 days. Police will be given access to, and copies of, the images for purposes in connection with the prevention and detection of crime and disorder. This CCTV will also comprehensively cover the beer garden area. Lighting will be sufficient to ensure quality CCTV images. All supervisory staff must be fully trained in its use. 3. The premises will operate as a public house providing seated dining. Substantial food will be available up to one hour before sales of intoxicants cease. 4. No persons under the age of 18 to be in the public areas of the premises after 7:00pm 5. There shall be no off-sales. Persons will not be permitted to leave the premises with drinks, glasses or bottles/cans. 6. Each entrance to the premises will be monitored by at least 1 member of door staff from 9pm on Fridays and Saturdays 7. Door staff employed at the premises will be Security Industry Authority (SIA) approved, and will work in line with the Government approved implementation plan. 8. A designated member of staff will monitor the outside drinking area at all times. 9. All windows and doors are to be closed at all times when live entertainment is present in the pub. 10. No music is to be played in external areas. 11. Noise to be inaudible at the nearest noise sensitive property after 23:00. If found necessary a sound limiting device will be fitted. 12. Clear and legible notices shall be displayed at exits and other circulatory areas requesting patrons to leave the premises having regard to the needs of local residents, in particular emphasising the need to refrain from shouting, slamming car doors, sounding horns and loud use of vehicle stereos and anti-social behaviour. 13. If there is occasion for live entertainment an announcement will be made at cessation, requesting that customers leave the premises having regard for the needs of local residents and keep noise to a minimum and manage their behaviour appropriately. 14. Where already used text/radio pagers will continue to be used for the additional hours of trading and will be monitored by a responsible member of staff. 15. A recognised proof-of-age scheme will be in place. 16. Children on the premises will be required to be supervised by an accompanying adult. 17. The Designated Premises Supervisor shall prominently display A4 notices in all external areas reminding patrons to be quiet and respect the needs of local neighbours and reminding patrons that the external area is to close at 24:00 hours. 18. The DPS must take a pro-active approach to noise control, checking outside the premises to ensure that noise is kept to a reasonable level and manage noise levels internally so as not to cause a nuisance to the nearest noise sensitive building. 19. An acoustic lobby is to be installed to the rear fire door entrance, following consultation with the Environmental Protection Service and as per proposed layout drawing 0015/07/1002 provided by White Design Architects. Regular checks of the outside area will be made by the premises team. Any customers involved in excessive loud behaviour will ask to desist. 20. Fencing around the perimeter of the external area is to be installed/reinstated following consultation with the environmental Protection Service and as per proposed layout drawing 0015/07/1002 provided by White Design Architect. 21. All external areas are to cease at 24:00 hours, seven days a week. After 19:00 hours children under the age of 18 are prohibited at the premises including external areas. 22. Lighting will be provided to ensure that the outside areas used in the hours of darkness are adequately lit. 23. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children. Any embedded permissions and restrictions attached to the justices on/off licence including those specified at Appendix 1. Specific conditions converted from the Public Entertainment Licence 1. Capacity 1) The number of members of the public who may be present at any one time on the premises or in any part of such premises specified below shall not exceed: - Area Capacity The whole of the premises 250 SHEFFIELD CITY COUNCIL Local Government (Miscellaneous Provisions) Act 1982 (Schedule 1 - Public Entertainments) STANDARD CONDITIONS OF LICENCE 1. CONDUCT OF PREMISES 2. EXITS (1) All exits for use by the public in leaving the premises shall be clearly indicated with the word "Exit"; those exits which may only be used in case of fire or other emergency shall bear the words "Fire exit" or "Emergency exit". Such notices shall comply with all relevant British Standard Specifications and, where practicable, be placed at a height of at least 6'9" above the floor and, wherever possible, shall be placed over the doors or openings to which they relate. (2) The doors and openings, other than exits, which lead to parts of the premises accessible to the public shall have notices placed over them indicating the use of such parts or be marked "Private". (3) Notices bearing the words "No Exit" or "No Way Out" shall not be exhibited. (4) All passages, courts, ramps and stairways to which the public have access, and which lead to the exterior of the premises shall at all times when the public are on the premises be kept free from obstructions. (5) Every door in the premises for the use by members of the public going to outside the building shall be so constructed and maintained as:¬ (a) to open outwards, unless the Council shall have been satisfied that this is impracticable in the circumstances of the particular case; (b) to open easily and fully in such manner that the door when open does not restrict the egress of the public; and (c) to enable it to be immediately opened from the inside while the public are present. Automatic Bolts or latches shall be of such a pattern that horizontal pressure on the cross-bars or pads will open the door, cross-bars shall, where practicable, be placed at a height of three feet from the bottom of the door. Doors fitted with automatic bolts or latches having cross-bars shall have the words "PUSH BAR TO OPEN" conspicuously displayed on the door in block letters at least four inches high. The cross-bars or pads shall be finished in a colour contrasting with the colour of the door and in areas where the lighting is not sufficient for the notice to be read at the maximum viewing distance the words "PUSH BAR TO OPEN" and the cross-bars shall be painted in fluorescent paint. (2) The licensee shall take all due precautions for the safety of the public, the performers, and the employees on the premises and, except with the approval of the Council in writing, shall retain control over all parts of the premises. (1) The licensee shall not permit drunkenness or any violent, quarrelsome or riotous conduct to take place in the premises. 3. LIGHTING (1) In all parts of the premises to which the public are admitted means of illumination shall be provided capable of illuminating those parts clearly (hereinafter called "the general lighting"). (2) (a) Means of illumination adequate to enable the public to see their way out of the premises shall be kept on at all times when the public are on the premises:- (i) in those parts of the premises to which the public are admitted except those which are lit equally well by daylight; and (ii) for the illumination of all notices indicating exits for use by the public; (b) The general lighting provided under Paragraph (I) of this Condition may be used for the purpose of this paragraph. (3) If at any time there is a failure of the lighting mentioned in sub-paragraph (a) of Paragraph (2) of this Condition, the parts of the premises and notices in the said sub-paragraph (a) shall immediately be illuminated by some alternative means of illumination adequate to enable the public to see their way out of the premises (hereinafter called "the safety lighting"). (4) (a) Any battery supplying safety lighting shall be fully charged before the public are first admitted to the premises on any day and shall be of such capacity and so maintained as to be capable of supplying at normal voltage the full load of the safety lighting during the whole time that the public are on the premises. (b) Any battery used to supply electricity for either the general lighting or safety lighting shall, at least once in every six months, have its capacity tested by a competent person appointed by or on behalf of the licensee and the date and result of the test shall be entered in a book to be kept for the purpose and produced for inspection whenever so required by an authorised officer of the Council. (5) (a) If there is a failure of the general lighting, the public shall, if the general lighting is not restored within one hour, be instructed to leave the premises. (b) If there is a failure of the safety lighting and the safety lighting is not by electricity, all parts of the premises required to be illuminated by the safety lighting shall be immediately illuminated by the general lighting and the public shall be instructed to leave the premises immediately. (c) If there is a failure of the safety lighting and the safety lighting is by electricity, all parts of the premises required to be illuminated by the safety lighting shall be immediately Illuminated by the general lighting and if the safety lighting is not restored within one hour, the public shall be instructed to leave the premises. 4. ELECTRICITY All electric fittings, wiring and appliances shall be constructed and maintained in a safe and satisfactory condition and to the satisfaction of the Council. Any electrical circuit serving a stage or similar part of the premises where the equipment of a performer is connected to the electricity supply for the building shall be protected by earth leakage contact breaker equipment positioned in close proximity to the place where the connection is to be made.
