Additional Conditions

• Annex 1A - Mandatory Conditions

   

  Mandatory Condition 1 (Section 19 ss 2)

   

  Where a licence authorises the sale of alcohol then no supply of alcohol may be made under the premises licence -

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  Mandatory Condition 2 (Section 19 ss 3)

   

  Where a licence authorises the sale of alcohol then every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Mandatory Condition 3 (Section 20)

   

  1.              Where a premises licence authorises the exhibition of films, the licence includes the following conditions relating to the admission of children to the exhibition:

  (a)              The admission of children (under 18) to the exhibition of any film must be restricted in accordance with the classification set by the film classification body (currently the BBFC).

  (b)              In a case where there is no classification given by the classification body (the BBFC) the admission of children to the exhibition of any film must be restricted in accordance with any recommendation given by the Licensing Authority.

  2.              In this section -

                “children” means persons aged under 18; and

                “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).

   

  Mandatory Condition 4 (Section 21)

   

  Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity each such individual must be licensed by the Security Industry Authority.

   

  Annex 1B - Mandatory Condition effective from 28th May 2014:

   

  1.              A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

   

  2.              For the purposes of the condition set out in paragraph 1-

  (a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

  (b) “permitted price” is the price found by applying the formula-

   

  P = D + (D×V)

  where-

  (i) P is the permitted price,

  (ii)D is the amount of duty chargeable in relation to the alcohol as if the duty were

  charged on the date of the sale or supply of the alcohol, and

  (iii)V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

  (c) “relevant person” means, in relation to premises in respect of which there is in force a

  premises licence-

  (i)  the holder of the premises licence,

  (ii) the designated premises supervisor (if any) in respect of such a licence, or

  (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;

  (d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

  (e) “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.

   

  3.              Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.

   

  4.              (1)              Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.

                (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

   

  Annex 1C - Mandatory Conditions effective from 1st October 2014:

   

  1.-(1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises-

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-

  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;

  (d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

  (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

   

  2. The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

   

  3.-              (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

  (3) The policy must require individuals who appear to the responsible person to be under

  18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-

  (a) a holographic mark, or

  (b) an ultraviolet feature.

   

  4. The responsible person must ensure that-

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml;

  (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

  (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

   

• Annex 2 - Conditions consistent with the operating schedule

  Any embedded permissions and restrictions attached to the justices on/off licence including those specified at Appendix 1.

   

  Specific conditions converted from the Public Entertainment Licence

   

  1. Capacity

   

  1) The number of members of the public who may be present at any one time on the premises or in any part of such premises specified below shall not exceed: -

  (1) Subject to sub-paragraph (2) below, the days and hours during which any public entertainment specified in the licence is permitted to be held shall be as follows: -

  (g) Sunday                   12:00pm      until                 10:30 pm

   

  (2) Where the Council is of the opinion that in order to avoid or reduce any disturbance of or annoyance to residents in the neighbourhood of the premises or the occurrence of disorderly conduct in the premises, it is desirable for the permitted hours specified in sub-paragraph (1) above to be varied, the Council may, after affording the licensee the opportunity of making representations to the Council, by notice served on the licensee vary the permitted hours and thereafter the hours specified in the notice shall apply in substitution for the hours specified in sub-paragraph (1) above.

  (Schedule 1 - Public Entertainments)

  STANDARD CONDITIONS OF LICENCE

   

  1.              CONDUCT OF PREMISES

   

  (1)              The licensee shall not permit drunkenness or any violent, quarrelsome or riotous conduct to take place in the premises.

  (2)               The licensee shall take all due precautions for the safety of the public, the performers, and the employees on the premises and, except with the approval of the Council in writing, shall retain control over all parts of the premises.

   

  2.              EXITS

   

  (1)               All exits for use by the public in leaving the premises shall be clearly indicated with the word "Exit"; those exits which may only be used in case of fire or other emergency shall bear the words "Fire exit" or "Emergency exit". Such notices shall comply with all relevant British Standard Specifications and, where practicable, be placed at a height of at least 6'9" above the floor and, wherever possible, shall be placed over the doors or openings to which they relate.

   

  (2)               The doors and openings, other than exits, which lead to parts of the premises accessible to the public shall have notices placed over them indicating the use of such parts or be marked "Private".

   

  (3)               Notices bearing the words "No Exit" or "No Way Out" shall not be exhibited.

   

  (4)               All passages, courts, ramps and stairways to which the public have access, and which lead to the exterior of the premises shall at all times when the public are on the premises be kept free from obstructions.

   

  (5)               Every door in the premises for the use by members of the public going to outside the building shall be so constructed and maintained as:

   

  (a) to open outwards, unless the Council shall have been satisfied that this is

                impracticable in the circumstances of the particular case;

   

  (b) to open easily and fully in such manner that the door when open does not

                restrict the egress of the public; and

   

  (c) to enable it to be immediately opened from the inside while the public are present. Automatic Bolts or latches shall be of such a pattern that horizontal pressure on the cross-bars or pads will open the door, cross-bars shall, where practicable, be placed at a height of three feet from the bottom of the door. Doors fitted with automatic bolts or latches having cross-bars shall have the words "PUSH BAR TO OPEN" conspicuously displayed on the door in block letters at least four inches high. The cross-bars or pads shall be finished in a colour contrasting with the colour of the door and in areas where the lighting is not sufficient for the notice to be read at the maximum viewing distance the words "PUSH BAR TO OPEN" and the cross-bars shall be painted in fluorescent paint.

   

  3.              LIGHTING

                                           

  (1)              In all parts of the premises to which the public are admitted means of illumination

  shall be provided capable of illuminating those parts clearly (hereinafter called "the general lighting").

  (2)(a)              Means of illumination adequate to enable the public to see their way out of the premises shall be kept on at all times when the public are on the premises:-             

  (i)              in those parts of the premises to which the public are admitted except those which are lit equally well by daylight; and

                              (ii)              for the illumination of all notices indicating exits for use by the public;

                              (b)              The general lighting provided under Paragraph (I) of this Condition may

                                            be used for the purpose of this paragraph.

   

  (3)              If at any time there is a failure of the lighting mentioned in sub-paragraph (a) of Paragraph (2) of this Condition, the parts of the premises and notices in the said sub-paragraph (a) shall immediately be illuminated by some alternative means of illumination adequate to enable the public to see their way out of the premises (hereinafter called "the safety lighting").

   

  (4)(a)              Any battery supplying safety lighting shall be fully charged before the public are  first admitted to the premises on any day and shall be of such capacity and so maintained as to be capable of supplying at normal voltage the full load of the safety lighting during the whole time that the public are on the premises.

    

      (b)              Any battery used to supply electricity for either the general lighting or safety lighting shall, at least once in every six months, have its capacity tested by a competent person appointed by or on behalf of the licensee and the date and result of the test shall be entered in a book to be kept for the purpose and produced for inspection whenever so required by an authorised officer of the Council.             

   

  (5)(a)              If there is a failure of the general lighting, the public shall, if the general lighting is not restored within one hour, be instructed to leave the premises.

   

  (b)              If there is a failure of the safety lighting and the safety lighting is not by electricity, all parts of the premises required to be illuminated by the safety lighting shall be immediately illuminated by the general lighting and the public shall be instructed to leave the premises immediately.             

   

  (c)              If there is a failure of the safety lighting and the safety lighting is by electricity, all parts of the premises required to be illuminated by the safety lighting shall be immediately Illuminated by the general lighting and if the safety lighting is not restored within one hour, the public shall be instructed to leave the premises.

   

  4.              ELECTRICITY

               

  All electric fittings, wiring and appliances shall be constructed and maintained in a safe and satisfactory condition and to the satisfaction of the Council. Any electrical circuit serving a stage or similar part of the premises where the equipment of a performer is connected to the electricity supply for the building shall be protected by earth leakage contact breaker equipment positioned in close proximity to the place where the connection is to be made.

   

  5.               ARRANGEMENT OF FURNITURE AND EQUIPMENT

   

  The furniture and equipment in the premises shall be so arranged as to allow free access to the exits and all gangways shall, while the public are on the premises, be kept free from obstructions.

   

  6.               FLOOR COVERINGS AND FURNISHINGS

   

  All floors, floor coverings and upholstery in the premises shall be maintained in a clean condition and kept free from broken glass and other litter which is likely to be a source of danger.

   

  (1)              Mats, matting and other floor coverings shall be secured and maintained so that they will not ruck or be in any way a source of danger and shall be laid in such a way that they do not project more than 13mm above the surrounding floor level.

   

  (2)              The hangings or curtains over exit doors or across gangways shall be made to part in the centre, to hang so as to be readily drawn aside and not to trail on the floor, and be arranged so as not to conceal notices.

   

  (3)              All fixed or permanent decorations, hangings and furnishings shall be of inherently incombustible materials or shall be treated and maintained so that they will not readily catch fire. Temporary decorations shall not be used except with the consent of the Council in writing and in accordance with any conditions of such consent.

   

  7.                 HEATING APPLIANCES

   

  (1)              Every heating appliance used in the premises which is so situated as to be within reach of any member of the public shall be fitted with guards which comply with the standards of construction and fitting required by the Heating Appliances (Fireguards) Regulations 1953, or regulations replacing those regulations, in the case of a heating appliance of a type which is so designed that it is suitable for use in a dwelling house or other residential premises.

   

  (2)              Every heating appliance used in the premises shall be situated sufficiently far from any woodwork, hangings or other materials or substances liable to catch fire for there to be no likelihood of fire by reason of their proximity to the heating appliance.

   

  (3)              Every heating appliance situated in a part of the premises to which the public are admitted shall be fixed in position.

   

  (4)              No oil-burning or liquified petroleum gas heaters other than those forming part of a boiler installation shall be used in the premises without the written consent of the Council and in accordance with any conditions of such consent.

   

  8.                 STAIRWAY AND PASSAGEWAYS

   

  The edges of the treads of steps and stairways shall be made conspicuous if so required by the Council. All gangways, exit ways and the treads of steps and stairways shall be maintained with a non-slip surface.

   

  9.               STAFF

   

  (1)              A responsible person who has attained the age of 21 years, being the licensee or some person nominated in writing by the licensee, shall be in charge of the premises at all times when the public are on the premises.

   

  (2)               Every member of the staff shall be instructed by the licensee or by some person nominated by the licensee in the safety precautions to be observed in the premises so far as those precautions relate to his duties, and in the action to be taken by him in the event of fire or other emergency.

  (3)               The number of attendants on duty excluding the licensee or the person nominated under sub-paragraph (1) above to assist persons entering or leaving the premises shall, in any case, not be less than one for every two hundred and fifty, or part of two hundred and fifty, persons present in the premises; and

  (a) if the number of persons present on any floor or tier does not exceed one

                                   hundred, there shall be at least one attendant on duty on that floor or tier;

  (b) if the number of persons present on any floor or tier exceeds one hundred,

                                   there shall be at least two attendants on duty on that floor or tier.

   

  (5)              At a public entertainment organised wholly or mainly as an entertainment for children under the age of sixteen years there shall be stationed on the lowest floor of the premises not less than one attendant who has attained the age of sixteen years for every hundred persons or part of one hundred persons present there and on each floor of the premises above the lowest floor there shall not be less than one such attendant for every fifty persons or part of fifty persons present there, and the number of such attendants stationed on any floor of the premises to which the public are admitted shall not be less than the number of exits for use by members of the public leaving that floor.

   

  10.               FIRE PRECAUTIONS

   

  (1)              The premises shall be provided with fire appliances suitable to the fire risks in the premises.

   

  (2)              The fire appliances shall be maintained in proper working order and be available for instant use. A record of the testing and maintenance of the appliances shall be kept and produced whenever so required by an authorised officer of the Council or the Fire Authority.

   

  (3)              All doors which are required by the Council to be resistant to fire or the passage of smoke shall be maintained self-closing and shall not be secured or provided with the means to secure them in an open position.

   

   

  11.               ALTERATIONS

   

  No alteration or addition, whether permanent or temporary, to the structure, the lighting, heating or ventilating installations or to the wall or ceiling coverings, shall be made except with the prior consent in writing of the Council. The licensee shall supply the Council with copies of such plans and specifications as the Council may reasonably require to enable any application for such consent to be considered.

   

  12.               SPECIAL EFFECTS

   

  (1)              Except with the consent of the Council in writing and subject to any conditions which may be attached to such consent, no laser, hologram or other special lighting effect equipment shall be used on the premises.

   

  (2)              Except with the consent of the Council in writing and subject to any conditions which may be attached to such consent, no smoke, or substance giving the appearance of smoke or producing a visible vapour, shall be used as part of or in connection with a Public Entertainment.

   

  13.               INFLAMMABLE SUBSTANCES

   

  Except with the consent of the Council in writing and subject to any conditions which may be attached to such consent, cylinders of compressed gas, explosives or highly inflammable substances (including canisters of liquefied petroleum gas) shall not be brought into or stored or used on the premises when the public are present.

   

  14.               HYPNOTISM

   

  Except with the consent of the Council in writing, and subject to any conditions which may be attached to such consent, no person shall give at the premises (otherwise than as provided by Section 5 of the Hypnotism Act 1952) any exhibition, demonstration or performance of hypnotism, mesmerism or any similar act or process which produces or is intended to produce in any other person any form of induced sleep or trance in which the susceptibility of the mind of that person to suggestion or direction is increased or is intended to be increased.

   

  15.               STAGE

   

  No stage or stand for the accommodation of spectators or participants in any public entertainment shall be used unless it, and any staircase (including any balustrade or handrail where required) are erected in accordance with:

  (1)               Building Regulations; or

  (2)              particulars approved by the Council under the provisions of

  Section 45 of the South Yorkshire Act 1980; or

  (3)              in any case where the above provisions do not apply and the stage or stand is more than 600mm above the floor upon which it is erected, such particulars as the Council may reasonably require.

   

  16.               CLOSING OF PREMISES IN THE EVENT OF DAMAGE

   

  (1)               In the event of the premises being damaged by fire or water and where any fault appears in/or damage is caused to, the ceiling, suspended fittings or structure which materially affects the safety of the premises, the public shall be instructed to leave the premises.

  (2)              The licensee shall notify the Council of any such fault or damage as soon as reasonably practicable, and in any case within seventy two hours of the occurrence thereof, and shall give the Council at least twenty four hours’ notice of any intention to re-open the premises to the public.

   

  17.               INSPECTIONS OF THE PREMISES

   

  The licensee shall arrange for a responsible person (of not less than 21 years of age) to inspect the whole of the premises (including means of escape) prior to the public being admitted and immediately after any public entertainment takes place. The responsible person shall record in a book kept on the premises for that purpose the date, commencement time and duration of each inspection referred to in this condition. The responsible person shall also record in the book any defects which are apparent at the time of an inspection and make a note of the action taken to correct those defects. If the responsible person referred to discovers any defect which could significantly affect the safety of the public on the premises, the premises shall not be used for a public entertainment until such time as the defect is remedied. The licensee shall give the City Council written notice of the defect within 48 hours of it being detected.

   

  18.               DRINKING WATER

   

  A wholesome supply of drinking water shall be available to the public, free of charge, at a suitable location(s) within the premises.
