• Annex 1A - Mandatory Conditions

   

  Mandatory Condition 1 (Section 19 ss 2)

   

  Where a licence authorises the sale of alcohol then no supply of alcohol may be made under the premises licence -

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  Mandatory Condition 2 (Section 19 ss 3)

   

  Where a licence authorises the sale of alcohol then every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Mandatory Condition 3 (Section 20)

   

  1.              Where a premises licence authorises the exhibition of films, the licence includes the following conditions relating to the admission of children to the exhibition:

  (a)              The admission of children (under 18) to the exhibition of any film must be restricted in accordance with the classification set by the film classification body (currently the BBFC).

  (b)              In a case where there is no classification given by the classification body (the BBFC) the admission of children to the exhibition of any film must be restricted in accordance with any recommendation given by the Licensing Authority.

  2.              In this section -

                “children” means persons aged under 18; and

                “film classification body” means the person or persons designated as the authority under               section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).

   

  Mandatory Condition 4 (Section 21)

   

  Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity each such individual must be licensed by the Security Industry Authority.

   

  Annex 1B - Mandatory Condition effective from 28th May 2014:

   

  1.              A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

   

  Annex 1C - Mandatory Conditions effective from 1st October 2014:

   

  1.-(1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises-

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-

  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;

  (d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

  (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

   

  2. The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

   

  3.-(1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

  (3) The policy must require individuals who appear to the responsible person to be under

  18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-

  (a) a holographic mark, or

  (b) an ultraviolet feature.

   

  4. The responsible person must ensure that-

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml;

  (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

  (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

   

• Annex 2 - Conditions consistent with the operating schedule

   

  1. A colour CCTV system to the specification of South Yorkshire Police will be fitted, maintained and in use at all times the premises are open.  CCTV images will be stored for 28 days.  Police will be given access to, and copies of images for purposes in connection with the prevention and detection of crime and disorder.

   

  2. No persons under the age of 18 years to be on the premises after 20:00 hours.

   

  3. Persons shall only be allowed to remove drinks from the premises in sealed containers.

   

  4. Sunday to Thursday the playing of live or recorded music after 01:30 hours shall be at a reduced volume, agreed by the Environmental Protection Service.

   

  5. A recognised proof of age scheme (eg Challenge 21) should be operated at the premises to prevent underage drinking and to ensure that that children under the age of 18 are not admitted after 8pm.

   

  6. A radio will be used to keep in contact with other premises in Sheffield.

   

  7. Such radio shall be kept in good working order and shall be monitored by a responsible member of staff or the designated premises supervisor when the premises are open for any of the licensable activities.

   

  8. Any incident of crime or disorder shall be reported to the police via the radio.

   

  9. Any female customer who needs to be searched will be searched by a female member of staff.

   

  10. No person who is drunk or disorderly will be allowed access to the premises.

   

  11. No person who is the subject of a court banning order will be allowed in the premises provided the details of such person have been provided to the premises by the police.

   

  12. Random searching will take place of those people suspected of carrying drugs or offensive weapons.

   

  13. Agreement will be reached with the police about the storage of such drugs or weapons recovered form customers and their delivery to the police.

   

  14. No customer will be allowed to bring open or sealed bottles on to the premises.

   

  15. No person will be allowed to leave the premises with any bottle or glass other than where such bottle has been given to the customer as a prize.

   

  16. Tables will be cleared of all empty bottles and glasses on a regular basis.

   

  17. CCTV shall be provided on the premises and shall be kept in good working order and any recordings from the CCTV shall be retained for a period of one month.

   

  18. A notice shall be displayed at the entrance to the premises that CCTV is in operation in the premises.

   

  19. A proof of age policy approved by the police shall be in operation to ensure no person under the age of 18 is sold intoxicating liquor.

   

  20. If required crime prevention notices will be displayed in the premises warning customers of any prevalent crime that may affect them.

   

  21. Any customer who behaves inappropriately will be barred form the premises.

   

  22. The premises will be a member of any local pub watch scheme.

   

  23. An incident book will be kept at the premises in which will be recorded all incidents of crime and disorder. This book will be reviewed by manager and area manager.

   

  24. All staff who work behind the bar will be fully trained to ensure that no person who is drunk or disorderly or who appears to be under the age of 18 is served with intoxicating liquor.

   

  25. The BBPA's Code of Practice in relation to Responsible Drinks Retailing will be observed.

   

  26. Any glasses into which drink is dispensed will be made from toughened hatterproof glass.

   

  27. The capacity for the premises shall be 450.

   

  28. An accurate record shall be kept of the number of persons admitted to each part of the premises such records retained for 12 months and made available to the police, fire service and Council.

   

  29. There shall be a suitable number of adequately trained staff to prevent overcrowding in parts of the premises, keep exit routes clear and prevent any standing on furniture or seats and to ensure the safe evacuation of people from the premises in the event of an emergency such staff will have been issued with specific duties in the event of an emergency.

   

  30. A Fire Evacuation Plan will be agreed with the Fire Authority.

   

  31. All staff shall have received training on the safe evacuation of the premises in the event of an emergency and such training shall be repeated at least once every 6 months. A record of the training provided shall be kept at the premises for at least 2 years and will be made available to the fire service or Council.

   

  32. Adequate arrangements will be made in the Fire Evacuation Plan to ensure the safe evacuation of any disabled persons in the event of an emergency and that disabled persons are made aware of those arrangements.

   

  33. All fire escape routes shall be kept unobstructed, free of trip hazards, in good order with non-slippery and even surfaces and will be dearly identifiable.

   

  34. All escapes doors and escape routes will be checked before the premises open for trading to the public and record of the check shall be maintained.

   

  35. All fire exit doors shall be available and shall be capable of opening without the use of any key, card, code or similar means.

   

  36. Fire doors will be self closing and shall not be held open other than by devices approved by the fire service.

   

  37. Edges to steps and stairways shall be maintained so as to be conspicuous.

   

  38. Hangings, curtains and temporary decorations shall be maintained in a flame retardant condition and shall not obstruct fire exits, fire safety signs or fire fighting equipment.

   

  39. Any upholstered seating shall comply with current fire safety regulations.

   

  40. Notices detailing the action to be taken in the event of fire or other emergency will be  prominently displayed in the premises.

   

  41. Access will be provided for the emergency services and will be kept clear and free form obstruction.

   

  42. Fire alarm/fire evacuation/emergency lighting tests will be carried out monthly and a  record maintained of those tests such records to be kept at the premises for at least 2 years and made available to the fire service and Council.

   

  43. All fire fighting equipment will be maintained in good working order and shall be available  for immediate use such equipment will be inspected annually by a competent person and records of those inspections must be kept at the premises for at least 2 years and made available for inspection by the fire service and Council.

   

  44. All fabrics and furnishings will comply with the relevant British standard with regard to fire resistance.

   

  45. At least one first-aider trained to deal with alcohol and drug problems will be on duty for  every 500 patrons and if there are more than one on duty their roles will be clearly defined.

   

  46. An adequate and appropriate supply of first aid equipment and materials shall be available on the premises.

   

  47. All emergency lighting and fire safety signage will be maintained in good working order and will not be altered without the approval of the Fire Authority. The emergency lighting will be capable of lasting at full capacity for not less than 3 hours.

   

  48. All electrical installations will be inspected by a competent person before the expiry of the current electrical certificate and the certificate issued will be the  current standard form certificate issued by that competent person's professional body.

   

  49. If any work is undertaken to the electrical installation it will be inspected, tested and certified the a competent person as soon as possible.

   

  50. All electrical socket outlets provided for entertainers portable equipment  must be protected by a residual current device which is part of the fixed wiring, such CDs to have a rated residual operating current not exceeding 30 milliamps and a maximum operating time of 30 milliseconds. The RCDs must be tested before the sockets are used for entertainers.

   

  51. No lasers, smoke machines or strobe lighting will be used without the prior  approval of the Licensing Authority.

   

  52. There shall be no demonstration of hypnotism without the prior approval of the Licensing Authority.

   

  53. An adequate supply of free drinking water shall be provided for all customers.

   

  54. Risk Assessments (including a fire risk assessment) will be carried out  annually and following such Risk Assessment an Action Plan will be prepared and any additional action required will be implemented.

   

  55. Dancing shall only take place on the dedicated dance floor on the ground floor which dance floor shall be even, maintained in good condition and shall be free of trip hazards.

   

  56. The holder of the premises licence shall maintain suitable and sufficient sound attenuation throughout the whole building.

   

  57. The holder of the premises licence shall ensure that a noise limiter is used and maintained as set up by a qualified noise consultant to ensure that noise from the premises shall not cause a nuisance to any residents.

   

  58. Clear notices/signs must be displayed near the entrance /exit doors reminding patrons to respect local residents and to leave the venue quietly.

   

  59. The placing of refuse into any bins shall take place at times that will minimise  disturbance to local residents.

   

  60. Noxious smells shall not be permitted so as to cause a nuisance to nearby local residents.

   

  61. Any lighting on or outside the premises shall not cause a nuisance to any nearby residents.

   

  62. Persons under the age of 18 will only be admitted to the premises if accompanied by an adult.

   

  63. All staff shall be trained to ensure that no person under the age of 18 years will be sold intoxicating liquor including the need for any person who looks under 18 to provide evidence of their age.

   

  64. The only form of identification which will be accepted as evidence of someone's age are Passport Photographic Driving Licence Proof of Age card agreed with the police.

   

  65. Signs shall be displayed on the door of the premises stating that any person who appears under the age of 18 will not be served with intoxicating liquor.

   

   

• Annex 3 - Conditions attached after a hearing by the licensing authority on the 1/2/2018 following an application for summary review submitted by South Yorkshire Police 12/1/2018

   

  1. A minimum of 1 in 5 customers, or such other frequency as agreed between SYP and the premises’ assessment of risk, to be searched upon entry by both wand and pat down.  This will include and private functions, if general members of the public can gain access to the event staging area.  Private functions will be exempt from this condition where movement between the private area and public parts of the premises is managed and monitored, and the venue has conducted its own risk assessment on that event and its clientele.

  2. All searches to be conducted in an area that is lighted and covered by CCTV prior to entering the main area of the venue, ideally the lobby.

  3. From 21:00 hours, or such earlier hour as informed by the premises’ assessment of risk, the venue will employ a minimum of 1 member of SIA staff from opening and thereafter 1 additional member of staff per 100 customers.

  4. The venue will have 2 working wands on the main entrance and 1 on the side entrance to assist with searching on entry and re-entry if required at the smoking external area backing onto Carver Street car park.  The wands will be used in conjunction with the search policy; if activated, security will conduct a more detailed search on that person under the CCTV search area.  Any person refusing a search shall be refused entry and CCTV to be notified by CCRAC radio.

  5. When SIA door supervisors are on duty, the venue will have at least one body worn camera with 4G streaming capability which will be used by SIA security on the door whilst the venue is open.  The camera will be used to record incidents and ejections at the venue, and the venue will be required to save the images for 28 days, and make them available to the Police upon request.

  6. ID scanner to be in place and in full working order.  The scanner shall be used in accordance with ‘Challenge 25’ and the management’s assessment of risk, save for events agreed with SYP.  The device may be used, but not limited to, capturing details of large groups or parties at the discretion of the venue.  Should the ID scanner by inoperative, because of malfunction or breakdown whilst the venue is open, SYP shall be notified via email, telephone of CCRAC radio that the unit is in disrepair.  The venue will seek assistance in its repair or replacement as soon as practicable.

  7. When trading beyond midnight, all drinks to be provided in polycarbonate/shatterproof glass drinking vessels.  Glass bottles are to be decanted into polycarbonate/shatterproof glass drinkware, unless supplied in plastic PET bottles.  By midnight, all non-permitted glassware shall have be removed and cleared away, with the exception of the VIP/Private area where:

                a. each booth/VIP area will be allowed 1 glass bottle per 3 customers at any one time.

                b. glass bottles and drinking vessels will be supplied by table service only

  When in use, SIA security staff will be assigned to the VIP are to ensure glass bottles are not removed from the booths/suite.  Staff training will include the management of glass within the VIP area.

  8. Decanting shall not be required during private pre-booked events, such as corporate events, in accordance with the management’s assessment of risk, and where movement between the private area and public parts of the premises is managed and monitored.
