and\par (e) \ldblquote value added tax\rdblquote means value added tax charged in accordance with the Value Added Tax Act 1994. \par \par \pard\ltrpar\fi-426\li426 3.\tab Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.\par \pard\ltrpar\li426\par \pard\ltrpar\fi-426\li426\tx426\tx709\tx993 4.\tab (1)\tab Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (\ldblquote the first day\rdblquote ) would be different from the permitted price on \tab the next day (\ldblquote the second day\rdblquote ) as a result of a change to the rate of duty or value added tax.\par \pard\ltrpar\fi-420\li420\tx709\tx993\tab (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning \tab on the second day.\par \pard\ltrpar\fi-283\li709\par \pard\ltrpar\ul\b Annex 1C - Mandatory Conditions effective from 1\super st\nosupersub October 2014:\par \par \pard\ltrpar\fi-426\li426\ulnone 1.\b0 -(1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.\par \pard\ltrpar\li426\tx426 (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises-\par \pard\ltrpar\li720 (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-\par \pard\ltrpar\li1440 (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or\par \pard\ltrpar\fi720\li720 (ii) drink as much alcohol as possible (whether within a time limit or otherwise);\par \pard\ltrpar\li720 (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;\par (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;\par (d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;\par (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).\par \pard\ltrpar\b\f1\par \pard\ltrpar\fi-284\li284\f0 2. \b0 The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.\par \pard\ltrpar\b\f1\par \pard\ltrpar\fi-426\li426\tx426\f0 3.\b0 -\tab (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.\par \pard\ltrpar\li426 (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.\par \pard\ltrpar\fi426 (3) The policy must require individuals who appear to the responsible person to be under\par \pard\ltrpar\li426 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-\par \pard\ltrpar\fi720 (a) a holographic mark, or\par (b) an ultraviolet feature.\par \pard\ltrpar\b\f1\par \f0 4. \b0 The responsible person must ensure that-\par \pard\ltrpar\li720 (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-\par \pard\ltrpar\fi720\li720 (i) beer or cider: \'bd pint;\par (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and\par (iii) still wine in a glass: 125 ml;\par \pard\ltrpar\li720 (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and\par (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.\f1\par \pard\ltrpar\lang1033\f2\fs16\par } "

• Annex 2 - Conditions consistent with the operating schedule

   

  1. Children will not be allowed in the shop unless they are ordering food.

   

  2. To comply with all Health & Safety issues.

   

  3. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.

   

  4. The sale of alcohol shall be subject to the provision of food.

   

  5. When delivering alcohol, driver will ask for ID of customer and check Name, Address, Telephone number and Age of customer.

   

  6. A Challenge 21 Scheme will be adopted and operated at point of sale and delivery of Alcohol, with appropriate signage displyed for customers to see.

   

  7. A refusals register will be kept and maintained.

   

  8. A CCTV system will be installed and in operation at all times premises are open.

   

  9. Signs will be displayed in the premises advising customers that consumption of alcohol is not permitted on the premises.

   

  10. Forms of ID which will be accepted will be Passport, Photo card Driving Licence, National ID card and cards issued by local schemes that have been verified through the Proof of Age Standard Scheme and the PASS hologram logo.

   

• Annex 3 - Conditions attached after a hearing by the licensing authority

   

  23.10.2007

   

  1. Suitable and sufficient means of escape and means for warning of fire are provided to deal with the inner situations. These are to meet the standards required by the South Yorkshire Fire & Rescue Service.

   

  2. The applicant must, at the end of the permitted opening hours, collect litter from a 10metre area around the shop, up to the edge of the pavement.

   

  3. The applicant must comply with the condition imposed by the Planning Permission for the premises, which relates to the requirement to have approved the extraction fan installed in respect of the premises and must make such an application for approval to the

  Planning Department of the Council, within 28 days of the date of the Determination Notice having effect, of which the Determination Notice is dated 29th October 2007.
