ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1.There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
2. The use of door staff/stewards will be risk assessed on an ongoing basis by the Licence Holder or Designated Premises Supervisor. Where engaged all staff shall be licensed by the Security Industry Authority.
3. Staff will receive training on matters concerning underage sales, drugs policies and operating procedures.
4. There shall be a zero tolerance policy in relation to drugs at the premises and there shall be regular checks by management to prevent the use of drugs by patrons. Drugs seized shall be stored securely and handed to the police.
5. The premises shall operate a proof of age scheme and will require photographic identification from any person who appears to be under the age of 21 years.
6. The management of the premises will liaise with police on issues of local concern or disorder.
7. There shall be no drinks promotions at the premises which are inconsistent with the need to promote responsible drinking.
8. To comply with the reasonable requirements of the fire officer from time to time.
9. The premises will have adequate safety and firefighting equipment and such equipment will be maintained in good operational order.
10.Staff will be trained on matters of safety, evacuation and use of emergency equipment as required.
11.Spillages and breakages will be removed as soon as possible to reduce the risk to patrons and staff.
12.Fire Exits and means of escape shall be kept clear and in good operational condition.
13.The use of plastic glasses in external licensed areas will be used on a risk assessed basis. Such risk assessment to be made available to the Police upon request.
14.Customers are requested, when leaving later in the evening to ensure they cause minimum disturbance and minimal noise in the club and the premises will put up notices to emphasis the point if required.
15.During regulated entertainment within internal licensed areas of the premises external windows and doors shall be kept closed save for access and egress of the general public and other than in an emergency.
16.The Premises Licence Holder shall prominently display A5 notice on all exits reminding patrons to leave the premises in a quiet and orderly fashion in respect of the local neighbours needs.
17.No regulated entertainment will take place in external/outdoor areas at the premises after 23:00 hours.
18.There shall be adequate controls in place including staff training to safeguard against the sale of alcohol to persons under 18 years.
19.The premises supervisor or appointed staff member shall ensure that when children are admitted to the premises their presence is not inconsistent with the style of operation of the premises at that time and the licensable activities that are being carried out.
20.Policies in relation to children shall be adequately communicated to patrons by staff or through appropriate signage
Conditions agreed by South Yorkshire Police 2nd February 2022
1. A CCTV system to the specification of South Yorkshire Police will be fitted both internally and externally, maintained and in use at all times whilst the premises are open . The CCTV images will be stored for 30 days and police and authorised officers of the council will be given access to images for purposes in connection with the prevention and detection of crime and disorder, in line with GDPR guidance. Members of the management team will be trained in the use of the system.
Conditions agreed by Health & Safety 2nd February 2022
1. A permanent fixed residual current device (RCD) must protect the electrical power serving all amplified music equipment used for the purposes of live music or similar entertainment
2. The following conditions will only apply in respect of large scale events provided in the external licensed areas (with large scale events being defined as events at which regulated entertainment comprising live and/or recorded music is being provided together with the number of attendees exceeding 500 persons)
a)An event management plan shall be prepared.
b)A suitably qualified ‘event safety officer’ shall be appointed.
c)Planning for the Event
The Premises Licence Holder shall appoint a suitably qualified noise consultant, to the approval of the Environmental Protection Service, to produce a Noise Management Plan (NMP). The NMP shall be produced no later than 6 weeks prior to the event and shall include details of predicted noise levels at nearest noise sensitive properties based on modelling, or actual noise measurements. The noise level predictions shall only be based on the sound system to be deployed for the event. The NMP shall detail measures for how noise will be monitored and proactively managed during the event. The appointed noise consultant shall liaise between all parties - Environmental Protection Service, Production Manager, DPS, sound system suppliers, sound engineers, Licensing Authority, on all matters relating to noise control prior to and during the event.
d)Prior to the Event:
A noise propagation test shall be undertaken with the Environmental Protection Service present, prior to the start of the event in order to set appropriate control limits at the sound mixer position. The sound system shall be configured and operated in a similar manner as intended for the event. The sound source used for the test shall be similar in character to the music most likely to be produced during the event.
The noise consultant shall ensure that prior to the event during any testing of equipment, minimum noise levels are emitted from the sound equipment to reduce to its lowest level any noise nuisance to local residents.
e)During the Event:
The noise consultant shall ensure that noise is monitored at the perimeter of the site (or other appropriate noise sensitive location) throughout the event, and at least during each different artist.
The noise consultant shall comply with any request made by a nominated officer of the Environmental Protection Service to reduce or remix sound emanating from the amplification system.
Facilities shall be provided on the mixing desk, or other appropriate position, for a nominated officer of the Environmental Protection Service to monitor and where necessary secure a reduction in noise level to a reasonable level.
f)After the Event
A compliance/ evaluation report shall be produced within 6 weeks of the event detailing monitored noise levels during the event, compliance with agreed levels, number of complaints received and action taken as a result of complaints, recommendations for future events.
