ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. There shall be no adult entertainment or services, activities, other entertainment or matters ancillary to the use of the premises that may give rise to concern in respect of children.
2. A CCTV system will be fitted, maintained and in use at all times whilst the premises are open. The CCTV images will be stored for 30 days and police and authorised officers of the council will be given access to images for purposes in connection with the prevention and detection of crime and disorder. Members of the management team will be trained in the use of the system.
3. The CCTV system of the premises will give clear unobstructed views of all customer seating areas (both interior and exterior), site entrances and exits and all other parts of the premises. The combination of the premises CCTV system and the wider Dyson Place site CCTV (both of which will have the ability to record footage for 30 days) will be in effect to prevent crime and disorder.
4. Customers’ use of external areas for seated dining or drinking purposes shall cease at 21:00 hours on all days.
5. No loudspeakers shall be fixed externally nor directed to broadcast sound outside the building at any time.
6. The outside seating area to the front of the premises shall not be used from 21:00-09:00hrs.
7. There will be no movement, sorting or removal of waste bottles, material or other articles nor movement of skips or bins outside the building between 22:00 and 08:30 hours on Monday to Saturday and 22:00 and 09:00 on Sunday and Bank Holidays. No deliveries to the building to be carried out between these hours.
8. There will be no collection of glass/bottle bins/skips and refuse bins/skips by collection contractors between 22:00 and 08:30 hours on Monday to Saturday and 22:00 - 09:00 hours on Sundays and Bank Holidays.
9. The basement area shall not be used by members of public.
10.The premises shall primarily operate as a restaurant/coffee shop for seated dining/drinking and the provision of alcohol shall be ancillary to the provision of food.
11. A Building Regulation Completion Certificate shall be submitted to the responsible authority for public safety within a reasonable time period after the premises has opened for business.
12. Strong management controls will be implimented and effective training of all staff will be completed so that they are aware of the premises licence and the requirements to meet the four licensing objectives. All the details of staff training will be documented in a Training Record Book that will always be readily available within the premises.
13. A zero tolerance policy towards drugs will be adopted and enforced, and all staff will trained with procedures relating to the prevention of, and vigilance towards drug use in the employee training manual. The premises is sufficiently lit and with adequate lines of site to all customer seating areas to ensure monitoring of drug misuse (and other crime and disorder) occurs continually.
14. Custom will not be sought by means of personal solicitation outside or in the vicinity of the premises.
15. Staff will be well trained in asking customers to use premises in an orderly and respectful manner and prevent drinking alcohol at the retail unit (ex. canned or bottled beer). Also, staff will be trained to not sell alcohol to drunk or intoxicated customers.
16. Customers will be given a call for last orders of alcoholic drinks 15 minutes before closing down and then service will be wound down by a quietening of recorded music being played until being asked to leave the premises no later than 30 minutes after closing time.
17. Clear and conspicuous signs will be placed around the premises reminding customers that when they leave the premises they do so quietly. Staff will also be trained to verbally request to customers to leave the premises quietly as not to disturb residents when leaving the premises late in the evening.
18. A clear and legible notice will be placed outside the premises indicating the normal hours under the terms of the premises licence during which licensable activities are permitted. Also, clear and conspicuous notices warning of potential criminal activity, such as theft, that may target customers will be displayed. All entrances, exits, walkways, steps and stairs will always be kept clear of obstructions in order to always allows for safe movement around, in to and out of the premises.
19. A log book or recording system shall be kept upon the premises in which shall be entered particulars of inspections made; those required to be made by statute, and information compiled to comply with any public safety condition attached to the premises licence that requires the recording of such information. The log book shall be kept available for inspection when required by persons authorised by the Licensing Act 2003 or associated legislation.
20. Any entrance, exits, steps or stairs in the premises will be clearly noted with a conspicuous sign to alert the public of such features.
21. A Health, Safety and Fire Risk Assessment will be completed by Peninsula Business & HR Services in order to identify key areas which need to be addressed in order to prevent harm coming to a member of the public or to a member of staff. All staff undergo training relating to risk assessments upon induction and physical copies of the risk assessment are always available on site.
22. Internal lighting and additional emergency lighting will be installed on the premises to ensure all walkways are well illuminated. The Dyson Place development has external street lighting to ensure all exits from the premises are also well illuminated. Emergency Lighting will be placed in various positions around the premises in order to help aid in exiting the property in the event of a power outage.
23. All parts of the premises and all fittings and apparatus therein, door fastenings and notices, lighting, heating, electrical, air condition, sanitary accommodation and other installations, will be maintained at all times in good order and in a safe condition.
24. All staff will be trained to perform underage checks inline with the “Challenge 25” policy in order to ensure alcohol is never sold to an underage individual. Staff will also be trained to not sell alcohol to a customer that is already drunk or intoxicated in order to prevent any harm coming to them or to another customer.
25. All external contractors visits will be arranged (where possible) at a time to ensure minimum contact with customers, and upon prior to arrival are required to read the business contractor health and safety handbook provided by Peninsula Health & Safety Services.
26. All windows for the premises are newly installed and double glazed which will help in preventing excess noise escaping the premises. Also, a maximum volume will be implemented for recorded music played inside the property at a level that doesn’t cause nuisance to the public in surrounding area. No music will be played outside. In the event of customers being too loud staff will be trained to politely remind them to lower their volume as not to disturb and members of the public outside of the premises.
27. Prominent, clear and legible notices will be displayed at the exit requesting the public to respect the needs of nearby residents and to leave the premises and the area quietly. Customers will not be admitted to premises outside of opening hours.
28. Customers will be asked not to stand around loudly talking in the street outside the premises.
29. Adequate waste receptacles for use by customers will be provided in the local vicinity.
30. Any lighting on or outside the premises will be positioned and screened in such a way so as to not cause a disturbance to nearby residents.
31. The "Challenge 25" Scheme will be implimented at the premises. Acceptable ID will include a card bearing the PASS hologram, a photographic driving license or a passport. If people over 18 wish to buy alcohol, staff are trained about the requirement for persons' identification, age establishment etc if they look under the age of 25. The Challenge 25 signage will be displayed in prominent locations throughout the premises.
32. Refusal Register Log Book will be kept upon the premises all the time.
33. After the hours of 6pm children will only be allowed on the premises when supervised by a responsible adult.
34. All entrances, exits, wallkways, steps and stairs will be kept clear of obstructions in order to always allow for safe moving around, in and out of the premises.
