Additional Conditions
1. The CCTV system as presently installed (as at the 12th August 2010) shall be maintained and in operation whenever the premises are open to the public and for two hours thereafter. CCTV images will be stored and retained for 31 days and the police and authorised officers of the Council will be given access for purposes in connection with the prevention and detection of crime and disorder. Any modification to the system shall be done after consultation with the police save that any reduction in the capacity shall be agreed with the police in advance. 2. No person under the age of 18 years to be on the premises during licensable activities unless an under 18 event is taking place between the hours of 7pm to 10pm. 3. At times when an under 18 event takes place, customers aged 18 years or over are prohibited and an age verification scheme shall operate at the door. 4. There will be a minimum of one hour between the end of an under 18 event and the club reopening as an adult venue. During this time security checks will take place to ensure all persons under the age of 18 years have exited the premises. 5. Events will be risk assessed and operate in compliance with the guidance provided by the Safeguarding Children Board and South Yorkshire Police. 6. South Yorkshire Police will be notified at least 7 working days prior to any under 18 event taking place. 7. Any person holding a Security Industry Act 2001 Personal Dispensation Notice will be authorised to act as security staff. The notice must be displayed in such a manner as the SIA Badge and produced for inspection by an appropriate authority. 8. The applicant or any person purchasing these premises must liaise with and fully comply with the reasonable requirements of the responsible authority towards public safety in the fit out/building of the premises. 9. The extended part of the premise, the capacity shall not exceed 250 persons. 10. The premises shall have in force and operate a challenge 25 policy that shall apply both at point of entry and to the premises and all points of sale of alcohol. The policy shall be recorded in writing and all staff shall be trained on the policy before making any sales. Records of training shall be retained on staff records and made available to the police and the licensing authority on request. 11. A minimum of one designated member of security staff must be assigned to verify the age of all persons who appear to be under the age of 25 years when accesing the night club. 12. The upper floor of the premises currently known as The Fez Club shall have a last entry time of 03:30 hours. Sale of alcohol will cease at 06:00 hours and closing time shall be 06:30 hours. The lower ground floor of the premises currently known as Replica will only open the same hours as The Fez Club as per condition 1, annex 3 with 7 days notice of South Yorkshire Police being informed. Summary Review Hearing held 12th August 2010 - conditions coming into effect 26th August 2010 at midnight: 1. There shall be no admission to the premises to any member of the general public who was not already in the queue directly outside the premises at 03:30 hours. Whereby the premises are open during a Bank Holiday period as specified on the licence the last entry to the general public will be 05:00 hours. 2. The premises shall risk assess their search policy on an event by event basis. A written record of the risk assessment shall be made in advance of the event an kept at the site for 6 months. This written record will be made available to the police or an officer of the Licensing Authority immediately upon request. 3. The premises shall have in force and operate at all time the premises are open to the Public, for licensable activity, a policy agreed with the South Yorkshire Police to prevent unlawful drugs being brought onto or used in the premises. The policy shall include measures on the searching of persons in private, procedures for the searching of males and females (including who can undertake them) and retention and disposal of any drugs taken. The policy shall be recorded in writing and all staff involved in its implementation shall be trained on the policy. Records of training shall be retained on staff records and made available to the police and the licensing authority on request.
